Podcast Publishing Authorization and Content Removal Policy

This Podcast Publishing Authorization and Content Removal Policy constitutes an agreement between Listenmode and any individual or legal entity that creates, submits, imports, claims, or manages a podcast through Listenmode.
By creating a podcast or submitting podcast content to Listenmode, you confirm that you have read, understood, and agreed to this policy.
1. Definitions
For the purposes of this agreement:
“Listenmode” refers to the Listenmode website, applications, APIs, administrative panels, and related services.
“Podcast Owner” refers to the individual or legal entity that creates, submits, imports, claims, or manages a podcast through Listenmode.
“Content” includes, but is not limited to:
- Podcast episodes
- Audio files
- Podcast titles
- Episode titles
- Descriptions and show notes
- Podcast artwork and images
- Music and sound effects
- Transcripts
- Logos and trademarks
- Guest names and personal information
- RSS feed information
- Any other material submitted to or displayed through Listenmode
3. Ownership of Content
You retain ownership of the Content you submit to Listenmode.
Submitting Content does not transfer ownership of that Content to Listenmode.
However, you grant Listenmode a non-exclusive, worldwide, royalty-free license to:
- Host and store the Content
- Cache and technically process the Content
- Convert or transcode audio when technically necessary
- Stream and distribute podcast episodes
- Display podcast artwork, titles, descriptions, and metadata
- Index the Content in Listenmode search results
- Make the Content available through Listenmode websites and applications
- Create technical previews, thumbnails, and excerpts
- Promote the podcast within Listenmode
- Display the podcast in recommendations, categories, charts, and editorial collections
- Use podcast names, logos, artwork, and limited excerpts to identify and promote the podcast
This license applies only for the purpose of operating, improving, distributing, and promoting Listenmode and the submitted podcast.
The license ends when the Content is permanently removed from Listenmode, except where temporary technical copies remain in backups, caches, logs, or systems required for legal and security purposes.
4. RSS Feeds and Externally Hosted Content
When a podcast is submitted through an RSS feed, you confirm that you have permission to submit and manage that RSS feed.
You authorize Listenmode to periodically retrieve and process information available through the RSS feed, including:
- Podcast metadata
- Episode metadata
- Audio file URLs
- Artwork
- Publication dates
- Descriptions
- Other information included in the feed
Listenmode may stream audio directly from the original hosting provider or temporarily cache, proxy, or process the audio when technically necessary.
You are responsible for ensuring that the RSS feed remains valid, accessible, accurate, and authorized.
Listenmode is not responsible for interruptions caused by:
- An unavailable RSS feed
- Expired or invalid audio URLs
- Hosting provider restrictions
- Changes made by the original hosting provider
- Deleted source files
- Incorrect feed information
- Third-party service failures
5. Prohibited Content
You may not submit, publish, or distribute Content that:
- Infringes copyright, trademark, privacy, publicity, or other legal rights
- Contains material you are not authorized to publish
- Is unlawful, fraudulent, defamatory, threatening, or intentionally misleading
- Violates the privacy or personal rights of another person
- Includes confidential information without authorization
- Impersonates another person, podcast, company, or organization
- Contains malware, harmful code, deceptive links, or technical abuse
- Promotes illegal activity
- Exploits or endangers children
- Contains unauthorized personal information
- Violates applicable laws, regulations, court orders, or government requirements
- Violates any additional content rules published by Listenmode
Listenmode may restrict or remove Content that it reasonably believes violates this policy or creates legal, security, operational, or reputational risk.
6. Responsibility for Submitted Content
The Podcast Owner is solely responsible for the submitted Content and any consequences resulting from its publication.
Listenmode does not independently verify the ownership, accuracy, legality, or licensing status of every submitted podcast.
You agree to cooperate with Listenmode when a complaint, ownership dispute, copyright claim, privacy request, or legal notice concerns your Content.
You are responsible for maintaining your own backup copies of all Content.
Listenmode must not be treated as the only storage location or backup system for a podcast.
7. Content Removal Requests
A copyright owner, podcast owner, authorized representative, guest, or affected individual may submit a content removal request to Listenmode.
A valid removal request should include:
- The requester’s full name
- Contact information
- The requester’s relationship to the affected Content
- The podcast or episode URL
- A clear description of the disputed Content
- The legal or factual reason for the request
- Evidence of ownership or authorization
- Any supporting documents
- A statement confirming that the information provided is accurate
- A signature or another reasonable method of confirming the requester’s identity
Removal requests may be submitted through:

Listenmode may request additional information before processing a removal request.
Incomplete, misleading, fraudulent, or unverifiable requests may be rejected.
8. Review and Removal Process
After receiving a removal request, Listenmode may:
- Review the submitted information.
- Request additional evidence from the complainant.
- Contact the Podcast Owner.
- Temporarily restrict access to the disputed Content.
- Remove the disputed episode or podcast.
- Restore the Content if the complaint is withdrawn or sufficiently challenged.
- Transfer management access to a verified owner where appropriate.
- Preserve relevant records when required for legal, security, or dispute-resolution purposes.
Listenmode is not required to resolve private ownership disputes between parties.
When ownership cannot be reasonably established, Listenmode may suspend the affected Content until the parties resolve the dispute through an appropriate legal or contractual process.
9. Emergency Removal
Listenmode may remove or restrict Content immediately and without prior notice when it reasonably believes that the Content:
- Creates an immediate legal risk
- Violates a court or government order
- Exposes private or sensitive information
- Creates a security threat
- Endangers a person
- Involves child exploitation
- Contains malware or harmful technical material
- Is clearly fraudulent or impersonates another party
- Seriously violates this agreement
Where appropriate, Listenmode may notify the Podcast Owner after taking action.
10. Counter-Notice and Objection
If your Content is removed or restricted, you may submit an objection or counter-notice containing:
- Your full name
- Your contact information
- The affected podcast or episode URL
- An explanation of why the Content should be restored
- Evidence of ownership, authorization, or licensing
- Any relevant contracts or supporting documents
- A statement confirming that the submitted information is accurate
Listenmode may forward relevant parts of the objection to the original complainant where legally permitted and reasonably necessary.
Submitting an objection does not guarantee that the Content will be restored.
11. Repeated Violations
Listenmode may suspend or permanently terminate accounts that repeatedly:
- Publish unauthorized Content
- Receive valid copyright complaints
- Submit fraudulent ownership claims
- Impersonate other creators
- Abuse the content removal process
- Re-upload removed Content without authorization
- Violate this agreement
Listenmode may consider the nature, frequency, severity, and context of each violation.
12. Podcast Removal by the Podcast Owner
A Podcast Owner may request the removal of their podcast from Listenmode.
Before processing the request, Listenmode may require identity or ownership verification.
Removal may not be immediate in all systems. Temporary copies may remain for a limited period in:
- Search indexes
- Caches
- Backups
- Security logs
- Audit records
- Systems required for legal compliance
Listenmode may retain limited account, consent, security, transaction, and dispute records where reasonably necessary or legally required.
13. Account and Access Security
You are responsible for protecting your account credentials and restricting unauthorized access to your account.
You must notify Listenmode as soon as possible if you believe that:
- Your account has been compromised
- Someone has claimed your podcast without permission
- An unauthorized person has modified your podcast
- Your RSS feed has been submitted without authorization
Listenmode may temporarily restrict account access while investigating a security or ownership concern.
14. No Guarantee of Availability
Listenmode does not guarantee that every podcast, episode, feature, page, or service will remain available without interruption.
Listenmode may modify, suspend, limit, or discontinue parts of the service for technical, legal, operational, security, or business reasons.
Listenmode is not liable for losses caused by:
- Service interruptions
- Hosting failures
- RSS feed failures
- Third-party services
- Deleted source files
- Incorrect metadata
- Account misuse
- Content removal performed under this policy
- Events outside Listenmode’s reasonable control
15. Indemnification
To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, and reasonable expenses arising from:
- Content you submit
- Your violation of this agreement
- Your infringement of another party’s rights
- False or misleading ownership claims
- Your failure to obtain required permissions
- Your misuse of Listenmode
16. Electronic Acceptance
Selecting the agreement checkbox and submitting the podcast creation form constitutes your electronic acceptance of this agreement.
You understand that your electronic acceptance has the same intent as signing a written agreement.
You must not create a podcast unless you have read, understood, and agreed to this policy.
17. Changes to This Agreement
Listenmode may update this agreement when necessary.
The updated version will be published on the Listenmode website with a new effective date or revision date.
Material changes may be communicated through the website, account dashboard, email, or another reasonable method.
Continued use of podcast management services after an updated agreement becomes effective may constitute acceptance of the updated agreement where permitted by law.
18. Governing Rules
This agreement is governed by the applicable laws and regulations of the jurisdiction in which Listenmode operates.
Nothing in this agreement limits rights that cannot legally be waived.
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Acceptance Statement
By selecting the checkbox on the podcast creation page, I confirm that:
- I have read and understood the Podcast Publishing Authorization and Content Removal Policy.
- I am authorized to create and manage this podcast.
- I own or have obtained the necessary rights and permissions for all submitted Content.
- I accept responsibility for the Content I submit.
- I agree to Listenmode’s content review and removal procedures.
- I agree to comply with this policy.
