Terms of Service

1. Acceptance of Terms

• By accessing or using ListenMode you agree to these Terms. If you do not agree, do not use the platform.
• Additional guidelines may apply to Studio publishing, imports, or specific features.

2. Eligibility

• You must be at least 13 years old and have legal capacity to enter this agreement.
• If you use ListenMode on behalf of an organization, you confirm you are authorized to bind that organization.

3. Accounts

• Keep your credentials confidential and use accurate account information.
• Do not share your account or use another person’s account without permission.
• You are responsible for activity that occurs under your account.
• We may suspend or restrict accounts that violate these Terms or create security risk.

4. User responsibilities

• Use ListenMode lawfully and respectfully.
• Do not attempt to disrupt the service, bypass security, scrape in ways that harm the platform, or misuse APIs.
• Do not harass others or post illegal or abusive material in comments or profiles.

5. Acceptable use

• No spam, malware, fraudulent schemes, or impersonation.
• No uploading or linking content you are not authorized to distribute.
• No attempts to harvest personal data from other users.
• No use of ListenMode to infringe copyright, trademark, privacy, or publicity rights.

6. Creator responsibilities

• If you create or manage a podcast, you must accept the Podcast Publishing Authorization and Content Removal Policy.
• You confirm you own or are authorized to publish the content you submit, including music, guests, and artwork.
• You are responsible for the accuracy of your show metadata and feed URLs.

7. Intellectual property

• ListenMode’s brand, software, design, and original platform content are owned by ListenMode or its licensors.
• Podcast content remains owned by its respective rights holders.
• You may not copy, modify, or redistribute ListenMode software or branding except as allowed by law or written permission.

8. Podcast ownership

• ListenMode does not claim ownership of third-party podcasts discovered via public catalogs or RSS feeds.
• Creators retain ownership of content they upload; they grant ListenMode a limited license to host, stream, display, and promote that content on the service as described in the Publishing Policy.
• Public listing of metadata is not a transfer of copyright.

9. RSS discovery and catalogs

• ListenMode may discover shows through Podcast Index and similar public sources, and through RSS feeds submitted by authorized users.
• Catalog completeness is not guaranteed. Feeds can break, move, or become unavailable.

10. Streaming disclaimer

• For many catalog and RSS episodes, audio is streamed from the original publisher’s media URL whenever possible.
• ListenMode may cache, proxy, or process media when technically necessary.
• Studio uploads are hosted to deliver creator-published episodes on ListenMode.
• We are not responsible for third-party hosting outages, expired media URLs, or publisher-side removals.

11. Content removal

• We may remove or restrict content that violates these Terms, the Publishing Policy, law, or safety requirements.
• Copyright holders may submit notices through our DMCA / Copyright Policy.
• Creators may request removal of their own shows subject to verification.

12. Platform rights

• We may modify, suspend, or discontinue features for technical, legal, or business reasons.
• We may present recommendations, categories, and editorial collections that include publicly listed shows.
• We may refuse service where reasonably necessary to protect users or the platform.

13. Termination

• You may stop using ListenMode at any time.
• We may suspend or terminate access for violations, repeated infringement, fraud, or risk to the service.
• Provisions that should survive termination (such as intellectual property ownership, liability limits, and dispute terms) will survive.

14. Limitation of liability

• ListenMode is provided as-is and as-available.
• To the fullest extent permitted by law, ListenMode is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the platform.
• Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Dispute resolution

• If a dispute arises, contact support first so we can try to resolve it informally.
• If informal resolution fails, disputes will be handled under the governing law section below, unless mandatory consumer protections in your country require otherwise.

16. Governing law

• These Terms are governed by the laws of the Islamic Republic of Iran, without regard to conflict-of-law rules that would apply another jurisdiction’s laws.
• Courts located in Iran have jurisdiction over disputes arising from these Terms, except where mandatory local consumer law gives you non-waivable rights to bring claims elsewhere.

18. Changes to Terms

• We may update these Terms. The “Last updated” date at the top of this page will change when we do.
• Continued use after an update means you accept the revised Terms, except where local law requires otherwise.
